RELEASE, WAIVER OF LIABILITY & INDEMNITY AGREEMENT

(Please Read Carefully Before Signing)

In consideration of being permitted to participate in the martial arts programs, classes, training sessions, competitions, events, and other activities offered by Creve Coeur BJJ LLC d/b/a Gracie Barra Chesterfield, and/or being permitted to enter any restricted area of the facility (defined as any area not open to the general public), I, the undersigned participant, or if the participant is a minor, I, the parent and/or legal guardian of the minor participant (collectively referred to throughout this Agreement as "I"), agree as follows:

1. Inspection of Facilities and Equipment

Before participating in any activity or using any equipment or facility, I agree to inspect the facilities, training areas, and equipment to be used. If I believe that any condition is unsafe, I will immediately notify an instructor or staff member and will refuse to participate until the unsafe condition has been corrected.

I further agree that if, at any time during participation, I believe any activity, equipment, or condition has become unsafe, I will immediately stop participating, remove myself or my child from the unsafe area, and notify academy staff.

2. Acknowledgement of Risks

I fully understand and acknowledge that:

A. Participation in Brazilian Jiu-Jitsu and other martial arts activities involves inherent risks that may result in serious bodily injury, illness, permanent disability, paralysis, property damage, or death.

B. The physical, emotional, social, and economic losses that may result from these risks can be severe.

C. These risks may arise from my own actions or omissions, the actions or omissions of others, the condition of the premises or equipment, or the ordinary negligence of Creve Coeur BJJ LLC d/b/a Gracie Barra Chesterfield, its owners, officers, managers, instructors, employees, agents, volunteers, or other participants.

D. There may be additional risks that are unknown or not reasonably foreseeable at this time.

E. I understand that photographs and/or video recordings may be taken while I or my child are participating in academy activities and may be used by Creve Coeur BJJ LLC d/b/a Gracie Barra Chesterfield for lawful promotional, advertising, educational, website, social media, or other business purposes.

3. Assumption of Risk

I voluntarily accept and assume all risks associated with participation in the activities offered by Creve Coeur BJJ LLC d/b/a Gracie Barra Chesterfield and accept full responsibility for any injury, illness, disability, death, property damage, or other loss that I or my child may sustain, regardless of whether such injury or loss is caused in whole or in part by the ordinary negligence of the Releasees identified in this Agreement, to the fullest extent permitted by applicable law.

4. Release, Waiver, and Covenant Not to Sue

I, on behalf of myself, my child (if applicable), my spouse, heirs, executors, administrators, personal representatives, successors, and assigns, hereby RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE Creve Coeur BJJ LLC d/b/a Gracie Barra Chesterfield, its owners, officers, managers, instructors, employees, agents, volunteers, affiliates, landlords, lessors, successors, and assigns (collectively referred to as the "Releasees") from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, and attorney's fees arising out of or relating to participation in any class, training session, competition, seminar, event, or other activity, or from the use of the facilities or equipment.

This Release includes claims arising from bodily injury, illness, disability, paralysis, death, or property damage, whether caused by the ordinary negligence of the Releasees or otherwise, to the fullest extent permitted by applicable law.

I further agree that neither I nor anyone acting on my behalf will initiate or maintain any legal action against the Releasees for any claim covered by this Release except where prohibited by applicable law.

5. Communicable Disease Acknowledgement

I understand that participation in martial arts training involves close physical contact and the shared use of facilities and equipment, which may increase the risk of exposure to communicicable diseases, including but not limited to COVID-19, influenza, MRSA, and other bacterial or viral infections.

I voluntarily choose to participate, or allow my child to participate, with full knowledge of these risks and knowingly assume all responsibility for any illness or exposure that may result from participation, to the fullest extent permitted by applicable law.
